This privacy policy tells you how Locker 2.0, Inc. (“Locker”, “we”, “us”, “our”) collects and processes information from members and users of the website, software applications, and other online services we provide (collectively, the “Services”). The Services include, but are not limited to, the Locker extension for web browsers (“Extension”) and the website located at www.wantlocker.com (the “Site”).

This Privacy Policy applies to all online communication with Locker. It is important for you to understand what information we collect about you during your visit and what we do with that information. Please note that your visit to the Site and use of the Services is subject to this Privacy Policy and the Terms of Use www.wantlocker.com/terms-of-use.

This Privacy Policy does not apply to the activities of our third-party sponsors, advertisers, licensees, affiliates and other partners that may collect your user information while accessing or using such third party's services in connection with your use of the Services. The privacy and information practices of those third parties are not covered by this Privacy Policy. To learn more about such third-party policies, we encourage you to read and review the privacy statements of each third-party services that you may choose to use in connection with Services. This Privacy Policy applies only to information collected by us.

NOTICE TO CALIFORNIA RESIDENTS

Pursuant to California Civil Code Section 1798.83, residents of the State of California have the right to request from companies conducting business in California a list of all third parties to which the company has disclosed certain categories of personal information during the preceding year for the third parties’ direct marketing purposes and the categories of personal information the company shares. Alternatively, the law provides that a company that has a privacy policy that provides consumers choice (opt-out or opt-in) regarding sharing personal information with third parties for their marketing purposes may instead provide information on how to exercise that choice. We qualify for the alternative option; we have a comprehensive privacy policy that sets forth that we only share personal information with third parties for direct marketing purposes if you specifically opt-in to such sharing at the time you provide personal information or at the time you choose to participate in a feature offered through the Services. If you do not opt-in at that time, we do not share your information with that identified third party for marketing purposes.

Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through this e-mail address.

TYPES OF DATA & COLLECTION METHODS

We may ask you to provide information that could reasonably be used to contact you or to identify you personally (such as first and last name, e-mail address, telephone number, birth date, mobile phone number, or home address (“Personal Information”)) or to provide information that allows us to facilitate transactions, activities and your use of the various features and functions we may make available from time to time. For example, we may collect Personal Information when you create user accounts, send questions or comments to us, or otherwise communicate or interact with us. We may also ask you to provide other information about yourself, such as demographic information (e.g., gender, zip code, age, etc.) and certain information about your preferences and interests (e.g., clothing/accessory sizing). If we combine demographic or other information we collect about you with Personal Information about you, we will treat the combined information as Personal Information.

1. Voluntary Submission:

Use of the Services: In order to provide the Services, Locker collects information that you share directly with us when you use the Site, Extension, or other Services. Though you don’t have to, you can choose to provide your name and email address to set up an account with us, which lets you, among other things, create and modify “collections” of fashion merchandise, see a personalized recommendation feed, set up and customize a user profile, and connect with other users of the Services. You can set up your Locker account with your name and other info for a more personalized experience. As you continue to use Locker’s Services, you might also provide information when you: create or edit collections, save merchandise to your collections, share collections or specific merchandise with other users, refer others to Locker, and “follow” stores or brands you like. In each instance, you will know what data we collect because you actively submit it through the applicable Service.

Forms, Help Requests, and Registrations: When you request information (for example, by interacting with our customer service department or through the Services, we may collect data such as your name, email address(es), mailing address(es), telephone number(s), and certain information related to your inquiry.

Updating or Removing your Personal Information: In case you change your mind or some Personal Information may change (such as your zip code), we will endeavor to provide a way to correct, update or remove the Personal Information you give us. You can do this by contacting us at info@wantlocker.com.

2. Automatic Collection: We may also collect, store or accumulate certain non-Personal Information concerning your use of the Services. For more information, see “Information We Collect Automatically As You Access and Use the Services” below. Information gathered may be used in aggregate form for internal business purposes, such as generating statistics, developing marketing plans, customizing content, and improving the Services. We may share or transfer such aggregate, non-Personal Information with or to our affiliates, licensees and partners.

3. As Required by Law; In the Event of a Sale: Locker may in its sole discretion disclose Personal Information in special cases: (1) when we have reason to believe that disclosing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to or interference with (either intentionally or unintentionally) our rights or to anyone that could be harmed by such activities; (2) when we believe in good faith that the law requires it; (3) to any third party who may acquire the Company; (4) in situations involving threats to the physical safety of any person; and (5) for tracking/verifying compliance with our policies as well as federal, state and local laws and/or for editorial and feedback solicitation purposes.

4. As Necessary to Provide the Services to You: Locker may contract with companies or individuals to provide certain services including email and hosting services, data management, surveys and marketing and/or promotional services, to assist in preventing or deterring fraud, etc. We may share Personal Information with such third parties solely as appropriate for them to perform their functions, but they may not use such information for any other purpose.

In general, the third parties used by us will only collect, use and disclose Personal Information to the extent necessary to allow them to perform the services they provide to us. However, certain third-party service providers, such as payment gateways and other payment transaction processors, have their own privacy policies in respect to the Personal Information we are required to provide to them for your purchase-related transactions. For these providers, we recommend that you read their privacy policies so you can understand the manner in which your Personal Information will be handled by these providers. In particular, remember that certain providers may be located in or have facilities that are located a different jurisdiction than either you or us. If you elect to proceed with a transaction that involves the services of a third-party service provider, then your information may become subject to the laws of the jurisdiction(s) in which that service provider or its facilities are located.

HOW WE USE YOUR DATA

We may use information collected through the Site, Extension, or otherwise through the Services, including your Personal Information, in order to: (1) allow you to participate in features we offer via the Services; (2) process your registration, including, at times, verifying that the e-mail address you provide is active and valid; (3) provide you with information that you have requested or agreed to receive; (4) tailor content, advertisements, and offers we serve you; (5) improve the Services and for internal business purposes; (6) contact you with regard to your use of the Services, and, in our discretion, changes to any of our policies; and (7) for purposes disclosed at the time you provide your Personal Information or otherwise with your consent.

We do not share your Personal Information with third parties for their marketing purposes unless you opt-in to such sharing at the time you provide your Personal Information or at the time you choose to participate in a feature on the Site. If you do not opt-in at that time, we do not share your information with that identified third party for marketing purposes. We may share non-Personal Information, such as aggregate user statistics, demographic information, and Usage Information with third parties; and third parties, including third party advertisers, content providers, and analytics providers, may collect such information when you use the Services. We may also share your information as disclosed at the time you provide your information, as set forth in this Privacy Policy.

MANAGING YOUR DATA

We’ve made it easy to opt out of Locker’s Services at any time.

You can always adjust your personal settings regarding what information you share with Locker and how Locker communicates with you by going to your account page and clicking on the relevant headings. Please note that limiting the information you offer to provide may impact Locker’s ability to provide certain Services to you.

If you want to stop using the Extension, we have instructions on how to uninstall the Extension on the Site www.wantlocker.com/Support. If you have any issues you can contact our support team for assistance by sending an email to info@wantlocker.com.

If you would like to delete your account or personal information, you can always ask us by emailing info@wantlocker.com. See section below entitled “Correcting, Augmenting or Deleting Your Information”.

OPTING-OUT

To keep you in control of your Personal Information and the communications directed to you, you may opt-out of the following services: You may opt out of receiving e-mail newsletters by following the opt-out instructions provided to you in those e-mails. Please note that we reserve the right to send you certain communications relating to your use of the Services and these transactional messages may be unaffected if you choose to opt-out from marketing communications. In accordance with our routine record keeping, we may delete certain records that contain Personal Information you have submitted through the Services. We are under no obligation to store such Personal Information indefinitely and disclaim any liability arising out of, or related to, the destruction of such Personal Information. In addition, you should be aware that it is not always possible to completely remove or delete all of your Personal Information from our databases without some residual data because of backups and other reasons. You may request that we remove Personal Information published in our member directory - by e-mail request to info@wantlocker.com.

We want to communicate with you via email correspondence only if you want to hear from us. If for any reason you would no longer like to receive email messages from us, you may contact us at info@wantlocker.com. In addition, if you do not want us to share your Personal Information with third parties, you may contact us at info@wantlocker.com to remove yourself. Please allow up to 10 days for us to process your request.

INFORMATION WE COLLECT AUTOMATICALLY AS YOU ACCESS AND USE THE SERVICES

Whenever you visit or interact with the Site, Extension or other Services, and/or our content, features, functions, or other Service activities we make available, we, as well as third-party advertisers, content providers and/or service providers who we do not control, may use a variety of technologies that collect information about how the Services are accessed and used (“Usage Information”). Usage Information may include, in part, browser type, operating system, the page served, the time, and the preceding page views. Usage Information is generally nonidentifying, but if we associate it with you as a specific and identifiable person, we treat it as Personal Information.

We also automatically collect your IP address or other unique identifier (“Device Identifier”) for the computer, mobile device, technology, item of equipment or other device (collectively, “Device”) you use to access the Site or Extension. A Device Identifier is a number that is automatically assigned to your Device when you access a web site or its servers, and our computers identify your Device by its Device Identifier. Some mobile service providers may also provide us or our third-party service providers with information regarding the physical location of the Device used to access the Services. The technologies used in the Services to collect Usage Information, including Device Identifiers, may include, but are not necessarily limited to:

Cookies. A cookie is a data file placed on a Device when it is used to access the Services. A Flash cookie is a data file placed on a Device via the Adobe Flash plug-in that may be built-into or downloaded by you to your Device. Cookies may be used for many purposes, including, without limitation, remembering you and your preferences and tracking your visits to our web pages. If you choose to disable cookies or Flash cookies on your Device, some features of the Services may not function properly.

Web Beacons. Small graphic images or other web programming code called web beacons, (also known as "1x1 GIFs" or "clear GIFs") may be included in the Services and e-mail messages. Web beacons may be invisible to you, but any electronic image or other web programming code inserted into a web page or e-mail can act as a web beacon. Web beacons or similar technologies may be used for a number of purposes, including, without limitation, to count visitors to the Services, to monitor how users navigate the Services, to count how many e-mails that were sent were actually opened or to determine whether content sent was actually viewed.

Embedded Scripts. An embedded script is programming code that is designed to collect information about your interactions with the Services, such as the links you click on. The code is temporarily downloaded onto your Device from our server or a third party service provider, is active only while you are connected to the Services, and is deactivated or deleted thereafter.

Although we will use the term “cookies” for ease of reference, we want to make it clear that in this Privacy Policy, the term “cookie” or “cookies” means and refers to not only cookies, but also to Web Beacons, Embedded Scripts, invisible GIFs and any other technological or operational means available to us to capture, track and obtain information.

Without limiting the foregoing, Usage Information collected through the Site or Extension in connection with access to the Services may include make and model of the device you are using to access the Services. If you access the Services from a mobile or other device, your unique device identifier assigned to that device or other transactional information for that device may be collected. This type of technology often includes an anonymous unique identifier that will track and store your user preferences while you are visiting and/or using the Services and/or your interaction with the digital retailers, as well as technical information about your use of the Services.

We may record the web page from which you linked to the Services (for example, another website or a search engine); the pages you visit on the Site; the website you visit after the Site; the ads you see and/or click on; other information about the type of web browser, computer, device, platform, related software and settings you are using; any search terms you have entered on the Site or a referral site; and other usage activity and data logged by us. We use this information for internal system administration, capacity planning, to help diagnose problems with our servers and generally to improve the operation of the Services. We may also use such information to gather broad demographic information, such as country of origin and Internet service provider or carrier. All of these technologies are designed give us information that can assist us to improve the Services and to more effectively personalize your experience using the Services. These technologies may enable us to relate your use of the Services to other information about you, including Personal Information.

By using the Services, you consent to the use of cookies as described above. In the case of actual “cookies,” most web browsers can be set to inform you when a cookie has been sent to you and provide you with the opportunity to refuse that cookie. Other technologies we refer to as cookies in this Privacy Policy, may not give you that option or even notify you as and when information is being collected. Refusing a cookie may, in some cases, preclude you from fully or properly using, or may negatively affect the display or function of, the Services, certain areas or features of the Services and/or the digital retailer functions.

CORRECTING, AUGMENTING OR DELETING YOUR INFORMATION

You can update and/or remove the information you have voluntarily provided to us by logging into your account on the Site or Extension. If you would like a copy of all of your Personal Information which we have collected, want us to delete all of your information or have questions about updating your information, please write to info@wantlocker.com. If you request that we delete all of your information, we may have to cancel your account.

CROSS-BORDER TRANSFERS

Your user information may be transferred to other countries in connection with your use of the Services. If you access or use the Services outside of the United States, your user information will be transferred to our servers as specified below.

WHERE WE STORE AND PROCESS DATA

We keep the data we collect in the United States of America and we may have contractors and employees around the world in various locations, including, without limitation, Asia and the European Economic Area.

POLICIES FOR KIDS (INDIVIDUALS UNDER 13 YEARS OF AGE)

The Site is a general audience website, and we do not knowingly collect Personal Information from guests younger than 13 years of age. No information should be submitted to or posted on the Site or Extension by guests under 13 years of age without the consent of their parent or guardian. Unless otherwise disclosed during collection, we do not provide any Personal Information, regardless of its source, to any third party for any purpose whatsoever from our guests under 13 years of age. No Personal Information collected from guests under 13 years of age is used for any marketing or promotional purposes whatsoever, either inside or outside the Services. We do not allow guests under 13 years of age to be listed in our member directory or to receive direct marketing communications from Locker or to be sent from our business and advertising partners.

If a parent or guardian of a child under 13 believes that the child has provided us with Personal Information, the parent or guardian of that child should contact us at info@wantlocker.com if they want this information deleted from our files so that it is not in retrievable form. If we otherwise obtain knowledge that we have Personal Information about a child under 13 in retrievable form in our files, we will delete that information from our existing files so that it is not retrievable.

LINKS TO OTHER WEBSITES

The Site may contain links to other websites that we do not own or operate. Such links may include, but are not limited to, retailers, advertising, sponsorships, promotions, recommendations, or links to other third party content. We are not responsible for the content, activities, or privacy practices of any third party websites, including the use of Personal Information about you collected by those websites and our provision of links to such other websites is not an endorsement by us of the those websites or any products or services they may offer. Those websites and the data that they collect and that you provide them are governed by the privacy policies of such websites and not this Privacy Policy.

SECURITY

The importance of security for all Personal Information associated with our guests is of utmost concern to us. We exercise great care in providing secure transmission of your information from your internet-enabled device to our servers. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your Personal Information, we can’t ensure or warrant the security of any information you transmit to us or from the Services, and you do so at your own risk. Once we receive your transmission, we make our best effort to ensure its security on our systems.

To the extent that you create an account, your Locker account will be password protected so that only you can access it and view the member information relevant to the account. We recommend that you do not divulge your password to anyone. We will never ask you for your password in an unsolicited phone call or email. Ultimately, you are responsible for maintaining the secrecy of your passwords and any account information. Remember to sign out of your account and close your browser window when you have finished your work. This is to ensure that others cannot access your Personal Information and correspondence if your computer is accessible to others or if you share a computer with someone else or are using a computer in a public place.

YOUR ACCEPTANCE OF THESE TERMS

By downloading and installing the Extension, visiting the Site, or otherwise using the Services, you signify your assent to the Locker Privacy Policy. If you do not agree to this Privacy Policy, please do not use the Services. Your continued use of the Services following the posting of changes to these terms will mean you accept those changes. Please note that we may change this Privacy Policy at any time. If we make any material changes we will notify you by email (sent to the email address specified in your account) or by means of a notice on the Site prior to the change becoming effective. We encourage you to periodically review this page for the latest information on our privacy practices.
